Approve Two Settlement Agreements for the Sunrise Development.

Executive Summary
The Director of Facilities & Construction, on behalf of the Superintendent of Schools, hereby requests the Board approve two settlement agreements for the Sunrise development.
Hernando County and the Owner/Developer entered into a Development Agreement dated September 12, 2023, for the Sunrise development. On December 16, 2024, the School Board filed an appeal of the Hernando County Planning and Zoning Commission's approval of the first Conditional Plat for the development. The Developer and the School Board disagree as to the status of school concurrency requirements set forth in the Development Agreement. All parties desire to resolve and end their dispute regarding school concurrency for the development.
The "Developer Settlement Agreement," between the School Board, the County, and the Owner/Developer, provides for the Developer to draft an amendment to the Development Agreement with terms and conditions for mitigating the development's impact to school concurrency that are acceptable to the School Board.
The "County Settlement Agreement," between the School Board and the County, provides for the postponement and withdrawal of the School Board's appeal, contingent upon the School Board's review and approval of the amended Development Agreement and subsequent approval of same by the County.
