Executive Summary
The Director of Facilities and Construction, on behalf of the Superintendent of Schools, hereby requests the Board Approve the Declaration of Restrictive Covenant for Anderson Snow Villas with Tri-County Development.
Anderson Snow Villas will be an age-restricted community (age 55 & over) that will generate no students, hence have no impact on the school district enrollment/capacity. The Declaration has been agreed to by the applicant. The restriction runs with the land and is binding on all parties and persons until such time as the property is released from the terms and conditions contained in the Declaration by both the Hernando County School Board and the Hernando County Board of County Commissioners. At such time of release, all applicable Impact Fees in effect at the time of the requested release are payable and the property will henceforth be subject to all school impact fees, other school district fees and charges in effect at the time of release, and all concurrency requirements including proportionate share mitigation.
This Declaration, when executed, will satisfy the Hernando County School Board with regard to exemption from the Educational Facilities Impact Fee Ordinance.
